ARTICLE 1 - SUBJECT
The present General Terms and Conditions rule all sales made by the company :
PY MANUFACTURE, 3, rue de Briord – 44000 Nantes – France (the sale of custom-made items and pieces of furniture).
ARTICLE 2 - PRICE
The prices of our products are indicated in Euros including all taxes (VAT applicable in France and other applicable taxes on the day of the order), unless otherwise specified and excluding handling and dispatch costs. Our prices are established ex-workshop; packaging, transport and supplementary costs are in addition.
In the case of an order to be sent to a country other than mainland France, you are the importer of the product(s) in question. Custom duties or other local taxes or import duties or state taxes are likely to be payable. These duties and sums are not the responsibility of the company PY MANUFACTURE. They will be charged to you and are entirely your responsibility, both in terms of declarations and of payments to authorities and appropriate organisations in your country. We recommend that you make enquiries with your local authorities about these aspects. All orders, whatever their origin, are payable in Euros. The company PY MANUFACTURE reserves the right to modify its prices at any time, but the product will be invoiced on the basis of the price applicable at the time of confirming the order and subject to availability. The products remain the property of the company PY MANUFACTURE until full payment of the price. Please note: as soon as you physically take possession of the ordered goods, the risks of loss or damage to these products are transferred to you.
ARTICLE 3 - ORDERS

Every order must be the subject of a written order form and signed by the customer. This order form serves as a confirmation.
Information subject to contract is presented in French and will be the subject of a confirmation at the latest at the time of the confirmation of your order. The company PY MANUFACTURE reserves the right to not record a payment and to not confirm an order for any reason whatsoever, and more specifically in the event of a difficulty concerning the supply of provisions, or in the case of difficulty concerning an order received.
ARTICLE 4 - CONFIRMATION OF YOUR ORDER
Any order that appears on the py-manufacture.com website assumes compliance with the present General Terms and Conditions. Any order confirmation generates your full and complete compliance with the present General Terms and Conditions, without exception or reserve. All the details provided and the confirmation recorded will be considered as a proof of transaction. You declare that you have full awareness of these. The order confirmation will be considered as a signature and acceptance of the operations carried out. A summary of information about your order and the present General Terms and Conditions will be sent to you in PDF format to the confirmation e-mail address of your order.
ARTICLE 5 - PAYMENTS
The fact of confirming your order implies for you the obligation of paying the price indicated.
The payment of your purchases is done by bank transfer from your account to the account of PY MANUFACTURE, whose bank details are the following : Download the IBAN
For items whose price exceeds 1 500 Euros, a deposit of 50% of the price including all taxes of the invoice will be paid; the balance of the payment will be made prior to the departure for delivery.
ARTICLE 6 - PRODUCTION & DELIVERY TIME LIMITS
If the product is in stock, the order is handled within two working days and then dispatched :
- Allow between 3 to 5 days for an A4 format package.
- Allow between 5 and 10 days for an A3 format package.
If the product is to be made according to an order or is very sizeable, such as an armchair, bench or table :
- Allow between 8 to 15 weeks, depending on the supply of materials and availability of our suppliers.
These time limits for production are counted from reception of payment of the deposit, which is considered as a definitive confirmation.
They are given indicatively and we make every effort to maintain them insofar as possible, but no delay can lead either to penalties at our expense, or to the cancellation of the order.
When the item is completed, it is immediately dispatched to the address indicated by the customer.
ARTICLE 7 - TRANSPORT
The merchandise travels at the risk of the recipient. All items dispatched are perfectly packaged by us and checked before departure. Any complaint must be made with the transporter at the time of delivery or within a time limit not exceeding 3 days, by registered letter. In order to improve our services and to control the quality of transport provided by our suppliers, we advise you to send us an e-mail informing us of your satisfaction or to notify us of the slightest problem.
ARTICLE 8 - FINISHING STAGES
Our items are created and made by hand with natural materials (metal - wood - stone - glass - leather). Variations of shade, colour, material and irregular sheen can appear, but they cannot be the subject of a refusal of the merchandise sold.
ARTICLE 9 - WITHDRAWAL
In accordance with the provisions of article L.121-21 of the Consumer Code, you have a withdrawal period of 14 days, during which to apply your right of withdrawal without having to justify your motives or pay any penalties. Returns are to be made in their condition of origin and must be complete (packaging, accessories, instructions). In this context, your responsibility is involved. Any damage sustained by the product at this occasion can be considered to thwart your right of withdrawal. Return costs are paid by you. In the event of carrying out your right of withdrawal, the company PY MANUFACTURE will proceed with the reimbursement of the sums paid, within a time limit of 14 days following notification of your request and via the same method of payment as the one used when you placed your order.
EXCEPTIONS TO THE RIGHT OF WITHDRAWAL
In accordance with the provisions of article L.121-21-8 of the Consumer Code, the right of withdrawal does not apply to :
- The supply of services carried out fully before the end of the withdrawal period and whose implementation began after the prior specific consent of the consumer and specific renunciation of his/her right of withdrawal.
- The supply of goods made according to the consumer’s specifications or clearly customised.
- The supply of goods which are likely to deteriorate or expire rapidly.
- The supply of goods that the consumer has unwrapped after delivery and cannot be sent back for reasons of hygiene or health protection.
- The supply of goods which, after having been delivered and due to their composition, are mixed indissociably with other items.
ARTICLE 10- AVAILABILITY
Our products are proposed as they can be seen on the py-manufacture.com website and in the limit of stocks available. For products that we do not stock, our offers are valid subject to availability from our suppliers. In the event of the unavailability of a product after your order has been placed, we will inform you about this by e-mail. Your order will be cancelled automatically and no bank debit will be made.
Furthermore, the website py-manufacture.com is not designed to sell its products in large quantities. Consequently, the company PY MANUFACTURE reserves the right to refuse all orders that contravene its ethics and values.For large quantities, please contact us directly.
ARTICLE 11 - DELIVERY
Products are delivered to the delivery address indicated during the order process, in a time limit indicated on the order validation page. In the event of a delay in dispatching your order, an e-mail will be sent to you to inform you of a possible consequence on the delivery time that had been indicated. In compliance with legal provisions, in the event of delivery delay, you have the possibility of cancelling your order in the terms and conditions set out in article L 138-2 of the Consumer Code. If you receive the product in the meantime, we will make its reimbursement, as well as the delivery costs in the conditions of article L 138-3 of the Consumer Code. In the case of delivery by a transporter, the company PY MANUFACTURE cannot be held responsible for a delivery delay due exclusively to the unavailability of the customer after several delivery appointment proposals have been made.
ARTICLE 12 - GUARANTEE
All our products have the legal warranty of conformity and the guarantee of hidden defects, provided by articles 1641 and following of the Civil Code. In the event of the non-conformity of a product sold, it can be returned, exchanged or reimbursed. All complaints, requests for exchange or reimbursement must be carried out by e-mail or sent by post within the time limit of 30 days after the delivery date. The products must be returned to us in the same condition in which you received them, with all the elements (accessories, packaging, instructions…). Dispatch costs will be reimbursed to you on the basis of the price invoiced and the return costs will be reimbursed to you on presentation of documents showing proof of payment. The provisions of this article do not prevent you benefiting from the right of withdrawal provided for in article 6.
ARTICLE 13 - RESPONSIBILITY
Beyond the total amount invoiced as part of each contract of sale, the responsibility of PY MANUFACTURE cannot be sought, whatever the motive or reason may be.
The products proposed are in compliance with the applicable French legislation. The responsibility of the company PY MANUFACTURE cannot be involved in the event of non-compliance with the legislation of the country where the product is delivered. It is your responsibility to check with local authorities the possibilities concerning the import or use of the products or services that you plan to order.
Moreover, the company PY MANUFACTURE cannot be held responsible for damage resulting from an incorrect use of the product purchased.
Lastly, the responsibility of the company PY MANUFACTURE cannot be involved for all the drawbacks or damage inherent to the use of the Internet, particularly in the event of a disrupted connection, a data breach or the presence of computer viruses.
ARTICLE 14 - APPLICABLE LAW IN THE EVENT OF LITIGATION
The language of the present contract is French. French law is the only applicable law for all our conventions. All cases of litigation and dispute, failing to reach an out-of-court agreement, will be judged by the tribunals of Nantes (44).
The French version of the General Terms and Conditions for export and for any document issued by PY MANUFACTURE takes precedence over any other translation. In the event of litigation, the tribunals of Nantes will be the only competent jurisdiction.
ARTICLE 15 - INTELLECTUAL PROPERTY RIGHT
All of our designs are filed for patent and have copy protection; and all the elements on the py-manufacture.com website are, and remain, the intellectual and exclusive property of the company PY MANUFACTURE. No person is authorised to copy, make use of, distribute or use in any way whatsoever, even partially, the elements of the website, whether they are the software, images or sound. The use of a simple link or link by hypertext is strictly prohibited without formal written consent from the company PY MANUFACTURE.
ARTICLE 16 - PERSONAL DETAILS
The company PY MANUFACTURE reserves the right to gather information relative to your name and personal information concerning you. These details are necessary for the management of your order, as well as to improve services and information we send you. They can also be sent to the companies that contribute to these relations, such as those responsible for carrying out services and orders for their management, implementation, processing and payment. This information and these details are also stored for security reasons, in order to comply with legal and regulatory obligations. In compliance with the law of 6th January 1978, you have the right, directly on the website, to access and correct this data, as well as to oppose information related to your name and to personal details that concern you.
ARTICLE 17 - ASCHEDULED ARCHIVING
The company PY MANUFACTURE will archive order forms and invoices on a reliable and durable media, constituting a true, correct copy in accordance with the provisions of article 1348 of the Civil Code.
